Lynchburg Misdemeanor Defense Attorney

A Trusted Legal Advocate for the Accused

Misdemeanors are the least serious of all Virginia crimes and cover a broad spectrum of unlawful actions. While these offenses have the most lenient penalties, a misdemeanor conviction can lead to fines, jail time, and probation. A conviction will also result in a permanent criminal record because Virginia does not have any type of expungement laws.

What are Misdemeanors in Virginia?

Under Virginia code, misdemeanors fall into four classes. Misdemeanors that do not fall into any of the pre-existing classes exist as well, known as unclassified misdemeanors. Penalties vary according to the type of offense but, as a misdemeanor, potential jail time will never exceed one year.

Virginia misdemeanors are categorized as:

  • Class 1, punishable by up to one year in jail and/or fine of up to $2,500
  • Class 2, punishable by up to six months in jail and/or fine of up to $1,000
  • Class 3, punishable with a fine of up to $500
  • Class 4, punishable with a fine of up to $250

Examples of a Class 1 misdemeanor include domestic violence, DWI, assault, petty larceny, and carrying a gun without a permit. Class 2 misdemeanors include driving without a license, reckless driving, and possession of a Schedule IV drug. Class 3 misdemeanors include possession of Schedule V drug and property damage. Class 4 misdemeanors include being drunk in public and possession of a Schedule VI drug.
